Calgary Bylaw Violated Freedom of Religion and Speech but Was Justified, Alberta Judge Rules

Former mayoral candidate Larry Heather intentionally violated the "inclusive" bylaw that prohibits protesters from being within 100 meters of venues hosting Drag Queen events.



"I'm the first person in all of Calgary to be convicted under this Safe and Inclusive Access Bylaw, but I did it to test its constitutionality," explains Heather.


The Court of Justice ruled that Heather's rights were violated; however, considering the cost of policing and the potential for conflict, it determined that "it was far better to have them separated by legislation."


Disappointed with the verdict, Heather is now appealing to the public for support in filing an appeal: "It's one thing to pay off a $250 fine, but to me that's not accomplishing anything, that's confirming that the bylaw is valid, I want to challenge the context and the validity of the bylaw itself."
